Our main goal is to provide high-quality services to our clients, and we will continue to revise your project until you are fully satisfied with the result. We won’t charge you any additional fees for revisions that do not involve any major changes to the original design concepts. Rest assured that we will deliver the revised designs to you within 48 hours of your request.

Turn Around Time
At Ever Cool Media, we strive to complete our web design services in a timely manner. Our turnaround time for the initial design iteration is typically 48-72 hours, depending on the complexity of the project. Please note that this does not include the total time required to complete the project from start to finish, as the revision process may take additional time. The number of revisions included in your package will determine the duration of the revision process, which may take a minimum of 48 hours to 72 hours or more, equivalent to 2-3 working days. We are committed to providing our clients with high-quality services, and we will work with you to ensure your satisfaction with the final product. If the concepts of the media service are not altered, you won’t be charged extra. Rest assured that you will receive your revised design within the agreed timeframe.

Here’s what you can expect from us:
• If you place an order or request revisions for any of our service or any of our other services on Monday, we will deliver the completed work within 48-72 hours.
• If you place an order or request revisions for content writing service or any of our other services on Friday, we will deliver the completed work by the end of the day on Tuesday.
• We offer a 100% Money Back Guarantee on all our services, but only on or before the first revision. If you’re not satisfied with the initial media service provided, you can request a full refund for your project.

Refund Policy
At Ever Cool Media, we offer a 100% refund for our media services that we provide. That is part of our refund policy for our media services; however, it’s essential to note that specific conditions apply, and the refund is not unconditional.

Please note that certain conditions still apply to our Refund Policy. The policy will be void if:
• You have selected a custom or special package.
• The primary concept for any media service has already been approved.
• The job for the media service has been done.
• You have already requested revisions to be made.
• The cancellation has been made due to reasons unrelated to the project.
• Our policies have been violated.
• Another company or media service provider has been approached for the same project.
• The creative brief does not contain the necessary information.
• A complete change in the media service has been requested.
• The request for refund has exceeded the given time span.
• The business is closing, changing its name, or altering its nature.
• Reasons such as a change of mind, disagreement with a partner, or other reasons that are not related to the media service will not be eligible for a refund under any circumstances.
• Clients who have approved multiple rounds of revisions (for any service) may be eligible for a 40% refund after consulting with their Project Manager.
• The approval of the refund will be at the discretion of Ever Cool Media’s management.
• The decision made by management regarding the matter will be final.
• If a client subscribes to a service bundle and is dissatisfied with a particular service, the refund will only apply to that specific service and not the entire bundle.
• Orders that are canceled before project initiation for reasons unrelated to the design service itself will be subject to a 30% cancellation administrative fee.

Please bear in mind that Ever Cool Media reserves the right to decline any project or terminate the contract at its discretion. Upon receiving a refund, you are not authorized to use the designs, written content, audios, videos, pictures, and/or any media files provided for any purpose, as they will become the exclusive property of Ever Cool Media. The company will retain full ownership of the designs, written content, audios, videos, pictures, and/or any media files provided.

How to Claim Your Refund
To initiate your refund process, kindly follow and use on of the steps outlined below:
• Call us to the number provided to you at the time of your contract.
• Send us an email to the email provided to you at the time of your contract.
• Set an appointment using the appointment form on our website.
• Contact us on the contact page of our website.

Once we receive your request for a refund, we will respond promptly. We will carefully analyze your request and process the refund according to our refund policy mentioned above. If you need to cancel a project for reasons unrelated to our service, please submit a refund request within 24 hours of placing your order to receive a full refund. If you request cancellation after the initial 24-hour period, a service fee will be charged. After receiving the refund, you will not have any rights to the media submitted by Ever Cool Media unless there is a mutual agreement between the company and the customer through written communication. We will ensure the legality of this agreement by submitting the information to the Copyright Acquisition of Government Copyright Agencies.

Delivery Policy:
• The order will be delivered to the account specified on the date mentioned in the Order Confirmation, and a confirmation email will also be sent.
• The turnaround time will depend on the package you have chosen, with a minimum requirement of 2 business days.
• To make a website live and/or deliver the media service, all payments must be cleared. Under no circumstances will a website be made live or a media service delivered if there are any outstanding dues.
• For urgent or rush orders, please contact our customer support team.

Design Ownership & Rights
Upon receiving a written request for finalization, Ever Cool Media will provide the client with the finalized designs, audios, videos, podcasts, written content, animations, and other media services. The client will then own 100% of the rights to these final core files.

• The client will own the final designs, audios, videos, podcast, written content, animations, and other media services provided by Ever Cool Media in their entirety.
• The client will have 100% ownership rights to the finalized media service ordered.
• The client is free to use the finalized designs, audios, videos, podcast, written content, animations, and other media services provided in any way they choose.
• However, any materials, media, or other content generated during any revision cycles leading up to the final product will remain the property of Ever Cool Media.

Content Creation & Population
Unless the content creation and population service has been purchased exclusively, Ever Cool Media will not be responsible for creating or adding any content (such as text, images, audio, videos, and any other media needed) to the requested media service. However, if this service has been purchased, the following terms will apply:

• Ever Cool Media will populate the ordered media service with content that has been created specifically for the client.

• The content, audio, picture, video, text, and any other media required for the requested service will be created exclusively for the client’s media service.

• Ever Cool Media will acquire stock media files, including but not limited to audio, video, text, animations, and other media files needed for the client from stock media websites.

• Media files will only be purchased upon client approval.

• Ever Cool Media will not assume any responsibility for any similarities between the media files used on the media service ordered and those from other stock media websites.

• While Ever Cool Media will fill the ordered media service with products and their details, the client is responsible for providing the product images and details.

Web Design Services
Payment and Fees: Payment for web design services must be made in full before work begins. Fees for web design services can be refundable under the refund policy of our media services.

Intellectual Property: The client owns all intellectual property rights in the design of the website, including any images or content created by Ever Cool Media.

Delays: Ever Cool Media will not be responsible for delays caused by the client, including delays in providing content or feedback needed to complete the web design project.

Revisions: Ever Cool Media offers a limited number of revisions to the web designs, as specified in the project contract.

The website will be deployed on a hosting server provided by us if the customer chooses one of our hosting packages.

Hosting: Ever Cool Media use MoxyDomain.com for hosting. The customer will have to choose our hosting package. If the customer decides to user our hosting partner we can offer Web Support and Maintenance as a separate package. Please not that if the customer chooses to host the website on another hosting company, Ever Cool Media will not be responsible for down times, updates, security, and/or any other any server or hosting-related problems.

Web Support and Maintenance: Ever Cool Media offers website maintenance and updates services, which can be purchased separately. Our support and maintenance will only be provided if the customer use our hosting services packages through our hosting partner. There is no Service Level Agreement (SLA) for technical assistance or service outage between Ever Cool Media and the client, unless it is purchased as an ongoing support and maintenance service separately.

Email setup: Ever Cool Media can only provide email setup if it is purchased by the client from us to our partner service provided. Ever Cool Media cannot provide email configuration and/or support if the email service is not provided on our website package. It is not the responsibility of Ever Cool Media to install the mentioned emails on the client’s end. Ever Cool Media is not liable for offering technical assistance or support in resolving email usage issues if it is not purchased from our website packages.

Content Writing Services
Payment and Fees: Payment for content writing services must be made in full before work begins. Fees for content writing services can be refundable under the refund policy of our media services.

Intellectual Property: The client owns all intellectual property rights in the content created by Ever Cool Media.

Revisions: Ever Cool Media offers a limited number of revisions to the content writing, as specified in the project contract.

Delays: Ever Cool Media will not be responsible for delays caused by the client, including delays in providing feedback needed to complete the content writing project.

Podcast Production Services
Payment and Fees: Payment for podcast production services must be made in full before work begins. Fees for podcast production services can be refundable under the refund policy of our media services.

Intellectual Property: The client owns all intellectual property rights in the podcast produced by Ever Cool Media.

Delays: Ever Cool Media will not be responsible for delays caused by the client, including delays in providing feedback needed to complete the podcast production project.

Revisions: Ever Cool Media offers a limited number of revisions to the podcast produced, as specified in the project contract.

Music Production Services
Payment and Fees: Payment for music production services must be made in full before work begins. Fees for music production services can be refundable under the refund policy of our media services.

Intellectual Property: The client owns all intellectual property rights in the music produced by Ever Cool Media.

Delays: Ever Cool Media will not be responsible for delays caused by the client, including delays in providing feedback needed to complete the music production project.

Revisions: Ever Cool Media offers a limited number of revisions to the music produced, as specified in the project contract.

Audio Engineering Services
Payment and Fees: Payment for audio engineering services must be made in full before work begins. Fees for audio engineering services can be refundable under the refund policy of our media services.

Intellectual Property: The client owns all intellectual property rights in the audio produced by Ever Cool Media.

Revisions: Ever Cool Media offers a limited number of revisions to the music engineering, as specified in the project contract.

Delays: Ever Cool Media will not be responsible for delays caused by the client, including delays in providing feedback needed to complete the audio engineering project.

Video Production Services
Payment and Fees: Payment for video production services must be made in full before work begins. Fees for video production services can be refundable under the refund policy of our media services.

Intellectual Property: The client owns all intellectual property rights in the video produced by Ever Cool Media.

Delays: Ever Cool Media will not be responsible for delays caused by the client, including delays in providing feedback needed to complete the video production project.

Revisions: Ever Cool Media offers a limited number of revisions to the video produced, as specified in the project contract.

Video Animation Services
Payment and Fees: Payment for video animation services must be made in full before work begins. Fees for video animation services can be refundable under the refund policy of our media services.

Intellectual Property: The client owns all intellectual property rights in the video animation produced by Ever Cool Media.

Delays: Ever Cool Media will not be responsible for delays caused by the client, including delays in providing feedback needed to complete the music production project.

Revisions: Ever Cool Media offers a limited number of revisions to the music produced, as specified in the project contract.

Limitations of Liability
Ever Cool Media shall not be held liable for any damages or losses resulting from the use or inability to use any of the services offered. Ever Cool Media will not be responsible for any technical issues or errors in the functioning of the website, software, or hardware.

Indemnification
You agree to indemnify and hold harmless Ever Cool Media and its affiliates, employees, agents, and third-party service providers from and against any claims, damages, or losses arising out of your use of the services provided by Ever Cool Media.

Termination
Ever Cool Media reserves the right to terminate your use of the services offered at any time for any reason. We also reserve the right to modify, suspend, or discontinue any of the services offered without prior notice.

Governing Law
This agreement shall be governed by and construed in accordance with the laws of the state of Florida. Any legal action arising out of or relating to this agreement or the use of the services offered by Ever Cool Media shall be filed and litigated in the state or federal courts located in Florida.

Entire Agreement
This agreement constitutes the entire agreement between you and Ever Cool Media regarding the use of the services offered. If any part of this agreement is deemed invalid or unenforceable, the remaining provisions shall remain in effect.

By using any of the services offered by Ever Cool Media, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, please do not use any of the services offered by Ever Cool Media.

Miscellaneous

VOID WHERE PROHIBITED:
